How to File for Divorce in Alberta
There are two possible courts to receive a ruling when filing for divorce in Alberta. There is the main Court of Queen’s Bench and there is also the Provincial Court’s Family Division. Based on the unique circumstances of your divorce, the Verhaeghe Law Office’s divorce lawyers will advise which court we will bring it to.
The subsequent steps of filing for divorce in Alberta are as follows:
Filing the Statement of Claim
This is a document which includes the date of marriage, birthdates of both spouses and any children along with terms for child support, custody and the terms of spousal support.
Serving the Statement of Claim & Answering
If you filed the Statement of Claim, then you become the plaintiff and your spouse will be served the claim and become the defendant. The statement must be served to your spouse in-person by another adult that is not you and your spouse will have 20 days to answer.
Contested vs. Uncontested
If your spouse answers by contesting, we then move forward to negotiations. Here, both parties will have to disclose all financial information so that they can accurately dispute custody and support issues. This can be a long and arduous process and this is where legal representation pays for itself as our team of divorce lawyers have plenty of experience negotiating the terms of a divorce with Lloydminster couples.
If the claim is uncontested, you will need to prepare a Request for Divorce, an Affidavit of Applicant and a proposed Divorce Judgement. The court will review everything that is submitted and sign off on it if they are satisfied.
Court is a Last Resort
The majority of divorces are settled out of court. Still, it isn’t entirely out of the question that negotiations break down and the final decision gets made by the court after hearing both parties. This is where divorces can very ugly and why you’ll be glad you have us in your corner.

Our divorce attorneys are skilled in handling this difficult time with care and compassion so that everyone involved can remain mentally and physically healthy through the process and have as painless a divorce as possible.
Prenuptial/Premarital Agreements
When two parties establish a prenuptial or premarital agreement at the beginning of their marriage, they are not likely assuming that the day they separate is going to come.
Because of this, when a separation does begin, it may be difficult for some to feel the urge to uphold the agreement.
These agreements usually establish property and financial rights of each spouse, but can include many other stipulations.
Navigating these contracts can be a difficult part of any separation, so it’s important even in an uncontested or collaborative divorce to ensure that all agreements are going to be met.
Child Custody
The most difficult aspect of any divorce is child custody. While some couples find it easy to split time between houses, custody agreements are generally difficult to arrive at, and even when they are finalized, can rear up again in the future.
At Verhaeghe Law Offices, your child’s best interest is our number one priority.
Having dealt with hundreds of separations in Lloydminister, we have helped many families come out as unscathed from custody proceedings as possible.
Property Division
Most marriages start off with the new couple purchasing a home or condo together. You both likely fell in love with this property and have many amazing memories that took place there.
In some cases, property division is simple. One partner loves the home more than the other. One is happy to start over fresh.
But a lot of the time, it is difficult deciding if the home is going to stay with one of you or if it’s better to sell and split the profits. Hiring a divorce lawyer you can help you mediate this decision which is an important part of any divorce.
At Verhaeghe Law Offices we’ve helped many families to figure out what direction they will take when it comes to property division, and we can do the same for you.
