Why do I Need a Will?
A will is the legal statement of a person’s last wishes about how to divide his or her property after death. This property is referred to as your estate, and will planning can also be referred to as estate planning.
If your wishes are expressed by word of mouth or personal document, not overseen by a witness and designating an executor, it can be easily contested as false.
In the case of passing without a will—referred to as “intestate”—provincial law determines who will get your assets. They will also determine who of your family members will be the best legal guardian for your children if you have any.
It is optional and voluntary to create a will, but very important to consider doing so.
Creating a Valid Will
There are two different ways to create a living will in Fort McMurray. The first, is a formal or “attested” will. Witnessed by two witnesses, it must be completely typewritten or printed. The second kind of will is completely handwritten and called a “holograph will”.
Anyone over the age of 18 can begin creating their will. It is optimal to do this while you are in good health and of sound mind, as your will can only be valid if you were mentally capable when making it.
